review Rawls’ thought experiment, the Original Position, and have covered Okin’s criticism of Rawls. I want you to come up with a set of rules that you think should be put into place in the home and in society that would ensure fairness.
Keep in mind, we want to consider what Okin says about knowing gender behind the veil of ignorance as she thinks this will better allow us to address injustices that occur due to not taking into consideration gender or biological sex. For example, biological females are the ones who give birth and thus special considerations should be given for one who can’t work during this time period, but also we can think about how that involves the role of their partner in this dynamic.
So, you are to imagine yourself as a member in the Original Position, who then goes behind the veil of ignorance, to determine at least four rules that you think should be put in place in the home that ensure that one’s home life is just. Then you are to determine four rules that you think should be put into place that will ensure that our society is just.
Remember behind the veil of ignorance you are to consider two principles when evaluating whether your suggested rule is just. Those principles are:
First Principle [Liberty Principle]: Each person has the same indefeasible claim to a fully adequate scheme of equal basic liberties, which scheme is compatible with the same scheme of liberties for all;
Second Principle [Difference principle}: Social and economic inequalities are to satisfy two conditions:
They are to be attached to offices and positions open to all under conditions of fair equality of opportunity;
They are to be to the greatest benefit of the least-advantaged members of society (the difference principle). (JF, 42–43)
When carrying out the Difference principle any application of this principle cannot violate the first principle – the Liberty principle. (From the Stanford Encyclopedia of Philosophy on Rawls)
Why do I mention these two principles? Well, when you do this thought experiment and think about your explanation for why your rules are ones that ought to be put into place in society or the home, you are to evaluate the rules by seeing if they cohere with these two principles. Also, you will note that any rule you pass must already have at the heart of it considerations of equality. So, you cannot put into place as one of your suggested rules that “everyone should be treated equally or fairly” as that is already a requirement in the Original Position. I want you to come up with specific rules that will ensure that everyone will be treated fairly in society or home and if there is any inequality that it is done with consideration that we are to be considered equal in terms of access to opportunity.
In short:
Use Rawls’s thought experiment, the Original position to come up with 4 rules for the home and 4 rules for society that will ensure fairness and equality of opportunity in the home and society. For each rule you should provide a good explanation for why you and your group members think that each rule will ensure justice either in the home or in society. DO NOT list as rules that everyone should be seen as equal or that everyone should be treated fairly. I want to know what specific rules that you think should be put into place to make sure that people are treated fairly and are equally considered.
