A group of local investors have approached you for advice. They know you took a property law course act Texas A&M Law school. They want to invest in a street car or inter urban venture that runs electric train cars between Fort Worth and Dallas. One of the biggest assets will be the real property on which the tracks sit. In your answer keep in mind that if the venture is not viable the major asset will be the real property rights which might be of value to third-parties if the property rights are transferable. Please share your opinion as to the best way to acquire such rights to the real property, the right to use the property for electricity as well as for streetcar use Please use essay format to share your opinion.

Due 04/30/2021 In your opinion should be investors buy the land in fee simple absolute with a warranty deed, or would an easement or right of way or other type of conveyance be preferable? What are the advantages of each type of conveyance versus fee ownership? Recommend how the investors should proceed with regard to acquiring the right to move a street car over real property using overhead electric lines. Keep in mind the street car it will be powered by electricity, and will need overhead power lines and power poles the entire distance between Fort Worth and Dallas. Some type of permission will be required from the property owner to move the electricity in addition to the right to use the train tracks. How is an easement different than a right away and how are they different than a general warranty deed?
