Instruction
Define and discuss the difference between mala in se and mala prohibita crimes. Be sure to give examples of each. How do these types of crimes fit within the concepts of norms/folkways and mores. Explain and be sure to be specific. Also, define and discuss the concepts of actus reus and mens res. Why are they so important and why are both required for legal responsibility? Finally, what are your thoughts concerning our criminal laws? Do you think they are too restrictive or fail law abiding citizens by allowing the “guilty” to go free? Why? I will ask a similar question at the end of the semester for you to gauge whether some of your opinions and perceptions have changed.
