Question: According to Lee Epstein and Thomas G. Walker, the judiciary has constraints on its power to review government acts through limits such as jurisdiction, justiciability, and standing to sue. Additionally, the judiciary is limited by other branches of government.
1. Provide an example of a justiciability standard (advisory opinions, collusive suits, etc.) that a case must meet for the Court to hear it. Explain what this standard is, and how do you understand the standard. You can provide an example from the book or provide your own example.
2. Name a way in which the separation of powers may constrain the decisions made by the U.S. Supreme Court. In other words, how do the other branches (executive and/or Congress) influence the judiciary to make it behave properly? This question is asking for an example. Explain how you understand this dynamic between the branches. Do you believe that the political branches of government should be able to influence the unelected judiciary?
