1. Officer West applies for a promotion to Lieutenant at the Gotham Police Department.
Commissioner Gordon tells him, “you’re a great officer and someday will be promoted,

who is a woman, with much less experience in the force, and who in the promotion exams scored way below West. Does officer West have an actionable claim against Gotham Police
Department? Explain why yes or why no. Also, explain and discuss under what federal statute he can seek relief? (5 points)
2. Officer Kyle is fired from the Gotham Police Force because she refused to participate in a
fundraising event for Commissioner Gordon’s campaign to become Mayor. She then files suit for political discrimination, as well as sexual discrimination against Gotham City in the United States District Court for the District of Gotham. In her sexual discrimination claim, she alleges that Officers Cobblepot and Napier, both males, were not fired and they likewise did not participate in Gordon’s fundraiser. Does Officer Kyle have actionable claims under Title VII and the First Amendment? Explain. (5 points)
