Tenth Class Assignment:
1. I once attended a Police Academy graduation in which all cadets had been trained in the use of tasers and batons. After the ceremony, I asked the mayor of one of the local governments why her graduating cadets did not have tasers? The response was that yellow tasers did not complement the officer’s uniforms and were an added cost. They were well off with retractable batons and firearms. Assume you are the attorney for that mayor, what would you advise regarding potential liability? Explain using a reasonable use of force analysis. (5 points)
(*Note-fortunately, in real life, the state police superintendent and provost of the academy,
as well as I convinced the mayor to buy the teasers).
2. In Gotham City a manifestation is taking place across City Hall to denounce the Mayor’s refusal to step down from office, following serious allegations of corruption. The protest
is peaceful, and protesters are all within the perimeter previously established by the police.
However, at 6 PM, past the time allotted by the protest permit, Commissioner Gordon wants to end the protest and thus, is about to instruct his officers to dissipate the protesters by the use of chemical agents. At that moment, district attorney Dent walks into Gordon’s office and hears about the plan. What advice should Dent give Gordon? Explain. (5 points)
