This assignment is for Criminal Justice course: #Chose four (4) of the following topics and write 1 to 2 pages for each one separately: Essay Questions: 1) The use of discretion is common in every part of the criminal justice system. Give examples where discretion is used in the policing, courts, and corrections systems, and explain whether you think it benefits or harms our overall ideal of justice. 2) The criminal justice system has many problems/inefficiencies. Name a(n) problem/inefficiency associated with each of the 3 areas of the criminal justice system and explain why it is not easily fixed. Police: Courts: Corrections: 3) Sanctions given out for criminal behavior range in severity from probation or diversion all the way to death or life imprisonment. What principles, values, and objectives should our system adhere to when prescribing a sanction? What should we avoid? What situations call for more or less severity in sanctioning? 4) There is a national debate asking whether terrorists that have been captured by law enforcement, should be tried in civilian courts or in military tribunals. Read about this issue online and make use of what we have covered in this class to explain your point of view on the subject. Make sure to address the concepts inherent in our Constitutional requirements for due process of law. 5) Some criminal defenses remove culpability from the offender. When someone is very young, mentally deficient/insane, or when another defense applies to the offenders situation, their criminal acts are not punished. Other explanations for criminal behavior, like a persons upbringing or history of being abused, do not effect a persons responsibility for their actions. Why do some explanations for crime provide a defense while other explanations do not? 6) What does justice mean to you? Does our criminal justice system provide justice? Where is justice best served in our system and where is it most lacking? 7) If a classmate suggested a law that made infidelity illegal, what consequences would this law have? What problems would this law have? In being passed by our legislature, in being policed, in being adjudicated, and in being sanctioned? 8) Generally, our nations laws restrict peoples individual liberties in order to promote social order. The Constitution, on the other hand, restricts the governments ability to infringe on peoples individual liberties. Compare the goals of our laws/statutes with the goals of our Constitution and give examples. 9) The US PATRIOT ACT gives governmental law enforcement agencies great latitude in investigating and preventing terrorism. This added safety comes at a cost to our individual constitutional liberties, and more specifically, the legislation severely infringes on peoples rights to privacy. Are the sacrifices made for safety problematic? What sacrifices are you willing to make for added security? Give examples. 10) Is our judicial systems current use of juries to decide innocence and guilt the best practice? Consider the alternatives, including; eliminating juries in favor of judges, using a panel of judges, making professional juries, or a Judge Dredd scenario--where police act as the judge and jury when making arrests. What are the pros and cons of each? 11) Is Miranda still necessary? Many cases since Miranda have changed how this requirement is applied, how has Miranda changed since it was made law? What purpose does it serve and can this be served in other ways?
