5 Pages Memorandum Subject : Welcome & Prosecution Memorandum Assignment Welcome to the United States Attorneys Office. gone well. Of course, before you get to present your case to a jury trial, the grand jury must return a true bill on your indictment. Your first case will be a white collar case based on your experience and expertise. Within a week or two, a Special Agent will post on Blackboard what he believes are the necessary facts to indict and convict the white collar crime scheme that youve chosen to write about. Dont worry about seeing the actual evidence that hes talking about, you can assume hes telling the truth with respect to the accuracy, credibility, and availability of the evidence and the witnesses. However, if you feel like there are gaps in the evidence, ask me and Ill give you the answers youre looking for. Your job is to prepare a prosecution memo that recommends one of three things: 1) Present the case to the grand jury for indictment immediately, 2) Send the case back for further grand jury investigation; or 3) Decline the prosecution. Im going to post on Blackboard a go-by of a prosecution memo that I did when I was a lowly line Assistant United States Attorney, like you are now. Ive also attached a Grading Rubric sheet to let you know what Ill be looking for in this assignment. If you have any questions, my door is always open unless its a Thursday night between 6 pm and 8:45 pm thats when I teach the greatest bunch of students in the history of the world about White Collar Crime. I dont use the term hero very often, but my White Collar Crime students are the greatest heroes in American History. Google it. One more thing, the statute of limitations runs on your case on April 23, 2015. It goes without saying that if you dont get your prosecution memo submitted to me by April 22, 2015, then you wont be able to indict any of the defendants. Just an FYI, if that happens, youll definitely get fired from the USAO, sued for prosecutorial misconduct, and your career will be over.
