Session 12 Assignment: Vice Crime Scenarios
THE ASSIGNMENT: For each of the federal acts listed below, students will provide (1) a brief definition of the acts purpose and (2) a hypothetical, using a defendant and a scenario, that illustrates a valid criminal prosecution under the act. You may use examples from the textbook, or create your own hypothetical. Just remember to cite when required!
Here is an example of what each of your responses should contain:
Rivers and Harbors Act
a. Definition: the first major environmental statute enacted by Congress. The Act authorizes the Army Corps of Engineers to regulate the use of the navigable waters of the United States. (Scheb, 2014)
b. Scenario: Peter Polluter owns a painting company. Instead of properly disposing of a few cans old paint, he goes out to the river behind his house and dumps the paint in the river. The river is a navigable waterway of the United States. Peter could be found criminally liable under the Act for discharging refuse matter into a navigable waterway. (NOTE: other crimes/statutes may also be implicated).
