Instruction
For this assignment, we are going to brief a particular issue that was raised in the civil lawsuit filed by Paul J. Manafort, Jr. against the Department of Justice, Rod J. Rosenstein, and Robert S. Mueller, III. The Justice Department filed a motion to dismiss Manafort's lawsuit. Manafort opposed the dismissal. On April 27, 2018, the judge issued an opinion denying the motion. I want you to brief this issue(s) presented to the judge. In your brief, you will need to submit a 1 page single-spaced memo that includes each of the categories below. Note that each category needs to be identified with a heading and the headings should be on the left side of your brief, underlined.
Explanation of Case Brief Categories
Case: Complete citation (1 point)
Facts: Who are the parties to the lawsuit and what caused this lawsuit to be filed? In your own words, include only the facts necessary to understand the case. List all important facts in the case in chronological order. You are summarizing the story that caused the lawsuit. (2 points)
Issue(s): What question(s) is/are the judge being asked to answer? If there are three issues, for example, label your issues: Issue 1, Issue 2, Issue 3. (6 points)
Reasoning: Identify the law upon which the judge is basing their order (i.e. decision). This can be the court’s interpretation of a constitutional provision or statute or a general legal principle such as negligence or strict liability. Then, apply the rule/law to the issues raised in the motion to dismiss and analyze each issue separately. If you are addressing three issues, label your reasoning for each issue: Reasoning - Issue 1, Reasoning - Issue 2, Reasoning - Issue 3. (6 points)
Conclusion: How did the court rule on each issue? Include a reference to the rule. For example, “Sam’s treatment did not proximately cause Trevor’s injuries, and so no negligence liability would exist.” (3 points)
