Reply on this: To better apprehend a breach of contract, it will be wise to put the focus on the contract first, then explore breaches of contract. A contract is a written or spoken agreement, especially one concerning employment, sales, or tenancy, that is intended to be enforceable by law.
The business world is full of agreements between companies and employees, contractors, consumers or other associates with the purpose of limiting the company's liability. Most businesses use formal written contracts in lieu of oral agreements when engaging in operations. Written contracts provide parties with a legal document addressing the expectations of both parties and how problems will be resolved. Contracts also are legally enforceable in a court of law. They engage a company liability - a situation in which the company might be sued or face other legal action that would require it to pay out money.
Breach of contract is a legal term that describes the violation of a contract or an agreement that occurs when one party fails to fulfill its promises according to the provisions of the agreement. Sometimes it involves interfering with the ability of another party to fulfill his duties. A contract can be breached in whole or in part. Breach of contract can be material, partial, or anticipatory. A material breach is one that is significant enough to excuse the aggrieved or injured party from fulfilling his part of the contract. A partial breach is not as significant and does not normally excuse the aggrieved party from performing his duties. An anticipatory breach is one where the plaintiff suspects that the offending party might breach a contract by doing or failing to do something that shows his intention not to complete his duties. Anticipatory breaches can be very difficult to prove in court.
When it comes to what a company stands for, the terms Mission, Vision, values are often perceived as a phrase describing one single thing, although they are three very distinct concepts for organizations.
The vision statement focuses on tomorrow and what the organization wants to become. The vision statement promotes growth, both internally and externally. A strong vision helps teams focus on what matters the most for their company. It also invites innovation. A purpose-driven company envisions success as a whole, because they know what success means for their company.
The mission statement focuses on today and what the organization does. It is the core of the business, and from it come the objectives and finally, what it takes to reach those objectives. It also shapes your company’s culture.
Company values, also known as corporate values or core values, are the fundamental beliefs upon which a business and its behavior are based. They are the guiding principles that a business uses to manage its internal affairs as well as its relationship with customers. They affect every aspect my business, from employee benefit packages and workplace culture to marketing strategies and customers service. Here are my company core values statement:
We are devoted to servicing our clients’ needs by providing our available resources and specialized knowledge in sales. Our mission is to provide personal and professional service by holding ourselves accountable and committing to our core values of exceptional service, building relationships, open communication, work ethics, accountability, and team work.
In sum, my company mission, vision and values determine how our contracts, generic breach of contract letter and employee handbook are crafted.
