Discussion Forum I need someone to complete a discussion question for me. The discussion question requires 3 short paragraphs in total. This question is based on unit 1 of the course. I have attached the course lessons for unit 1 below. Please review unit 1 to get an idea of the employment law terminology. Discussion Question: Examine your own employment relationship (or, if you are not employed, consider another work relationship with which you are familiar. Name two or three outstanding or interesting features of the rules that govern the relationship between employer and employee. What do these rules tell us about the relationship of the parties to the employment contract? the parties respective rights and obligations to each other? the protections and guarantees that are deemed necessary? the conditions under which the contract of employment underlying the relationship was negotiated? I worked as a Receptionist for a small non-profit organization (25 employees). Company did not have an HR department or HR Representative. Many past employees claimed they were harassed and didnt feel safe on the job but the Management/ Board never dealt with these cases which resulted to high turnover. The Individual can make up the rest of the employment scenario/details as long as they include terminology from unit 1 and it answers all the questions above. Here is are example answers submitted by a couple of the students: Student #1 I worked for many years as a subcontractor for a small business. When i was first hired there was almost no negotiation regarding any of my conditions underwhich i was hired, i was simply told i had the job, then to show up. There was never a written contract, or a full verbal discussion detailing my contract, just an affirmation that i recieved the position. In the end the reason i left the position was becuase of an issue that should have been discussed upon my hiring, but was left out of discussion, and becuase it was not discussed or written, i had no leverage or position to use when facing my employer over the issue. This experience taught me that even if you are a contractor, which seems to give you more control over your own working situation, the employer still holds the ultimate position of power in the relationship, as the employee is subject to thier service. The conditions underwhich the employement contract was created were not ideal, becuase i was a young employee looking for my first `big time job` i did not understand or know about my rights to negotiate my employment relationship, which later created problems; especially since i was never given a written contract of employment even after repeatedly asking for one for clarification of the employment terms. Not having a written contract or a clarified and negotitated terms of employment often left me worried and confused about my rights and entitlements when working for this employer. Knowing what i do now, i would never enter an employment contract like that again. Student #2 I currently work for a private motor vehicle registry as an Alberta Registry Agent that is governed by Service Alberta that is ran by the Alberta government. In this work relationship I am obligated to abide by the policies and procedures that are set not only by my employer, but I also have to follow very strict policies and procedures that are governed by Service Alberta. This means that if I break any of the policies or procedures that are issued by Service Alberta, I could lose my job and potentially get fined or even imprisoned depending on the act that was done out of line for example: fraud, false documentation, etc. I first had a very casual interview with the owner, and the job was offered to me the next day over the phone. Before I first started there I needed to obtain a clean criminal record check from both the RCMP and Edmonton City Police as well as negotiate my position, wage, and hours. The first day I had to read over the policies and sign that I understand them and that I need to follow them with everything I do. I also had to sign a form saying that my wage was confidential and that if I were caught conversing openly with other about it, I could lose my job. I started at this registry full time and now since I am a full-time student they have accommodated me to work part-time in the hours that work best for me. Another very interesting thing about my work is the fact that I know for sure that they have broken some laws when it comes to hiring. They have outright talked about prohibited grounds of discrimination in interviews, whether it be upfront, or non-chalant. This includes not hiring certain applicants because they are unable to work on Sunday's for religious purposes, not hiring women because they have children to take care of, and even asking me personally if I was going to have children in the future. To be honest I don't even think the owner even realizes that they are discriminating against people, which is illegal.
