How is the Texas Constitution changed?
As you've read in your text, changes to the Texas Constitution are proposed by the state legislature, but can only be approved by a majority vote in a statewide election. Last year, voters adopted all seven amendments proposed by the state legislature.
Gambling is generally prohibited in the Texas Constitution. There are several narrow exceptions - parimutuel horse and greyhound racing was the first, followed by the establishment of a state lottery. An additional exception, approved in 2015 and expanded in 2017, allows certain professional sports teams to hold raffles for charity.
Texas has a hurricane problem. State lawmakers created "TWIA," the Texas Windstorm Insurance Association, in 1971 following Hurricane Celia, to provide windstorm and hail insurance to the coastal areas of Texas. After Hurricane Harvey, TWIA is "broke, in debt and facing a shrinking revenue pool."
Texans - especially on the Gulf Coast - want to gamble. TWIA needs cash to stay in business. What if we tried to solve both problems at once? House Joint Resolution (H.J.R.) 36 by Representative Joe Deshotel (D-Beaumont) would amend the Texas Constitution to allow casino gambling in "certain coastal areas of the state" to provide money for TWIA.
