There is an interesting article published in the Medical Law International, published by Sage Journals, Physician Assisted Suicide in Oregon: The ‘Death with Dignity Data,’ (see the pdf file) written by Wendy E. Hiscox in 2007. It is 20+ pages long but may assist you with this assignment. Assume that you work for a law firm that has been hired by a man whose wife is dying of a terminal illness. The wife has been suffering greatly and the pain has become unbearable. The husband has retained your firm to know what his rights are as far as ending his wife’s life, and how it can be done. Look at the laws in your state, along with the standards set forth in Washington v. Glucksberg (1997), page 581 in your text, and prepare a legal memorandum outlining the legal standards for assisted suicide in your state. Address whether your state allows physician-assisted suicide, what criminal laws exist regarding this, whether these laws interfere with the right to privacy and due process, and whether your state recognizes living wills.
