  • While the families did get a settlement of $8 million dollars, they did not receive the justice they wanted. The families weren't in it for the money, they wanted the parties reliable for the containment of wells G and H to be held accountable for their neglect. Unfortunately for the families, Judge Skinner decided to break the case into two phases which weakened the case for the families. During the first phase, Beatrice Foods was found not liable for the contamination of wells G and H due to insufficient evidence. Also during the first phase, W.R.Grace was found liable for the containment of the wells even though the jury could not determine when the containment occurred. W.R. Grace filed and was granted a motion for a mistrial due to inconsistencies in the investigation. Instead of starting a new case, W.R. Grace decided to settle with the plaintiffs outside of court, publicly denying their role in the containment of wells G and H.

They wanted the company to have death and pollution connected to the W.R. Grace name. I would also support the fact that despite being found guilty of contaminating the wells, W.R. Grace filed and was granted a motion for a mistrial due to inconsistencies in the investigation whereby, rather than seeking for fresh case, W.R. Grace was given the opportunity to settle with the families outside the court. Though W.R. Grace paid the families justice was not done since they were not punished; something the families wanted.
