Project Summary: One way courts achieve flexibility is in the ability of courts to distinguish between precedents. Recall that stare decisis, the doctrine of precedent, involves standing by decided cases with a similar set of facts. Courts sometimes state that the present facts differ from those on which previous decisions were based and reached a different ruling.
