A duty of care is owed to customers Duty of Care is to Inspect the property, identify potential hazards, warn customers, and take steps to fix the issues. Breach of the Duty of Care - if you identify the business breached the duty of care, then explain how and why it contributed to the customer being injured. Causation - was the breach of the duty of care the related cause to the customer falling, or would the customer have fell regardless. Damages - any suffering, or physical injuries and medical bills and related treatment the customer requires to get better. NEGLIGENCE MEMORANDUM ON COMMERCIAL / BUSINESS PROPERTY Purpose To apply the elements of Negligence / Premises Liability to an actual situation you locate on your own. The goal is to identify a potentially dangerous situation in a business setting for customers (not employees at work, and not at a home or other residential area), assess, and provide a proposed resolution to the potential issue(s). Format You will draft a brief memorandum, 2 pages, double-spaced, including some photographs of the identified hazard to briefly share with your class in an informal discussion. Negligence Analysis You must apply the negligence analysis in a proactive manner, to address a potential risk you identified to the company and explain why they could face liability IF someone were to get injured, based upon the application of the negligence analysis, and the duties of care a business owner has to its customers. Your Recommendation In closing, your memorandum must include your recommendation on what you feel the company should do based upon the potential risk you identified. Pre-Meeting / Review You will be assigned a day and time to meet to review the status of your project and to receive guidance on your final memorandum.
