This is a moot assignment, you need to prepare 2 and half page argument as the appellant for the party J.J. and present it before the panel of judges. - I will attach the link for the case. You are representing J.J. against Rankin (Garage): Rankin lost the case in Supreme Court of Canada and now he is going to appeal in a Higher "made-up" court. [the sole issue whether Rankin owed duty of care to JJ]. We have to make an argument and prove that Rankin owed "duty of care" to J.J. Break down your arguments according to the ANNS TEST (foreseeability/proximity). - Make sure you add the ANNS test (Canada) in the argument. Read the case, look over judges comments, and apply them to the test. refer to case law. I will also attach a document, that will help you understand Duty of Care and the Anns test (foreseeability/proximity). (when you open the document scroll down to DUTY OF CARE page (16) and understand it. ANNS/COOPER test page (21). If you have any further questions please feel free to ask.
