LEGAL CASE STUDY 1: Martin v. Baehler, No. 91-C11-008, 1993 WL 358843 (Del Supr. Ct. May 20, 1993) This action arises out of an alleged and unauthorized release of confidential information regarding the plaintiff Stephanie Dempsey Martin. The Plaintiff alleges that on December 5, 1989, while a patient of Dr. Baehler, she was found to be pregnant. On December 19, 1989, Idella L. Fontana, an employee of Dr. Baehler contacted the plaintiff's grandmother, and without consent or justification informed the grandmother of the pregnancy. On the same day also, without consent or justification the defendant Idella Fontana also informed the plaintiff's mother and stepfather.

Date Posted: 19/09/2019
Category: Law
Due Date: 19/09/2019
Instruction
1. In that the defendant told only family members of the plaintiff about the pregnancy and did not broadcast the information to the general public do you feel that there is sufficient cause of action for invasion of privacy? 2. Even if you decided that there was insufficient cause for an action based on invasion of privacy, could the action of telling the family be ethically justified? 3. In that the physician was not involved in the telling of the family, why was he listed as a defendant? What legal principle justifies his being listed?
