SCENARIO PAPER: BALANCING AGGRESSIVE COLLECTION WITH THE PROTECTION OF CIVIL LIBERTIES ASSIGNMENT INSTRUCTIONS OVERVIEW This assignment is intended to promote reflection on the interpretation and practical implementation of correct ethical actions within the Intelligence mission context. In this scenario you are newly promoted and assigned to a civilian “joint duty” assignment at the DHS, an IC agency that is quite different from the one you have worked in for all your career to date. Use the article by Swan as background for your office environment. (The Swan article can be found in this Module: Week’s Learn section as, Read: DHS Has A Program Gathering Domestic Intelligence – And Virtually No One Knows About It.) In your new role, you have joined a team that has been working for 6 months on foreign threats to US election integrity and is meeting weekly with leading social media and major news organizations. You observe activity in your first meeting that makes you uncomfortable. You have also had discussions with some of your team that is negative about past activities and especially the press articles on the Twitter files revelations. After some reflection, you decide to draft a guidance paper for your team to provide boundaries on the discussions. Your paper will have to get approval from your boss, the agency deputy director and must reference authoritative guidance, provide practical procedures for the team, and maintain the relentless focus on protecting election security which is an issue with Presidential level attention. INSTRUCTIONS This paper should focus on ethical issues related to the boundaries and limits of intelligence collection and actions against US citizens. You are encouraged to review the history of the Church committee investigations from the 1970s as well as more recent IC actions, Congressional oversight hearings and various commentary.
